THE ARBITRATORS
CHOOSE THE ARBITRATOR
If a Party wants or must appoint its arbitrator, they can rely on Arbitrando, which shall provide names of some of its members deemed suitable to the task based on the specific skills required or necessary from time to time. Each member has undertaken towards Arbitrando, but also in the interest of its users, to act fairly and in accordance with the Code of Ethics of the Chamber of Arbitration of Milan.
In order to enable to Association to correctly select names to be put forward, the request should specify the following information:
– names of litigating Parties;
– subject matter of the dispute;
– value of the dispute;
– main language used in dispute documentation;
– brief description of the case;
– governing law, should that not be in dispute;
– contact addresses for the requesting Party or its attorneys;
– any other information deemed suitable.
The request should be made in writing, signed by the requesting Party (or by its attorney or authorised proxy) and emailed to the following address: info@arbitrando.eu
The Association, after acquiring any other information or clarifications from the Party, shall provide the requesting Party with a short list of names, prepared based on the following criteria:
- expertise
- no incompatibility
- knowledge of the main language used in dispute documentation
- number of cases already referred
- availability of prospective arbitrator
The requesting Party shall be free to select a name from the proposed list, and they shall likewise be free not to select any. In any event, they shall be required – for the sake of organisation – to notify the Association in writing within twenty days from receiving the short list; should the Party report in such notice that they wish to rely on one of the proposed arbitrators, Arbitrando shall put the Party in touch with the selected prospective arbitrator. Any further contact or agreement shall be the exclusive remit and responsibility of the Party and of the selected arbitrator, if hired.
The Association provides its assistance free of charge, and no remuneration of any sort shall be due by the Party and/or by the arbitrator hired, if any, as a result of the activities described above.
